United States v Martinez-Torres

Martinez-Torres appealed three conditions of supervised release. The panel, lamenting the failure of district courts and attorneys to pay attention at sentencings when supervised release and restitution are decided, vacated the conditions and remanded for further proceedings. It noted that the government conceded the ban on alcohol and the requirement to undergo sex offender assessment were plain error and the panel held that the ban on viewing legal sexually explicit material was not supported n the record by individualized consideration of Martinez-Torres’ circumstances.
