Utah Supreme Court holds homebuyers who do not contract directly with homebuilder cannot sue for construction defects unless construction warranties are assigned at time of purchase; dismisses appeal of denial of motion to vacate judgment as moot; and holds attorney waived argument that competing law firm claimant to attorney fees failed to properly intervene.
