State v Thomas

Thomas appealed the restitution order in his criminal sentence. The panel affirmed holding the district court considered Thomas’ income, expenses, mental health challenges and employment prospects before setting the restitution amount and payment schedule and thus did not abuse its discretion in ordering full restitution and an 8 year repayment schedule.

Veazie v RBC Ranch LLC and Benson

Ranch and Benson appealed a contempt order and entry of default on Veazie’s nuisance claim. The panel dismissed for lack of jurisdiction holding the contempt order was civil in nature as it compensated Veazie for Benson’s spoliation of evidence and thus is interlocutory and neither the contempt order or the default order are reviewable until after judgment is entered.
