State v Garcia

Garcia sought review of the court of Appeals decision that the district court lacked jurisdiction over his challenge to a restitution order of the Board of Pardons and Parole. The Court affirmed holding that restitution orders of the board are not subject to judicial review under Utah Code 77-27-5(3), that the requirement under Utah Code 77-27-6 to docket the restitution order and facilitate collection through civil process does not change the outcome, that a Court of Appeals decision to allow review of Board issued restitution orders was incorrect and thus unpersuasive and that Garcia waived his constructional changes to 27-5(3) provisions by omitting them in his opening brief.
