State v Martinez

The State appealed the district court order granting Martinez motion to suppress. The Court reversed. It held that there was no 4th Amendment violation here as officers are allowed to ask for a passenger in a car which has been lawfully stopped to voluntarily present identification and run a warrants check for eth passenger as this is consistent with United states supreme Court precedent allowing officers to take steps to insure their own safety during traffic stops and further noted this holding is consistent with those of federal circuit decisions and the weight of state case law. It also held that the extension of the stop here was reasonable as the warrant check took between one and five seconds.
